Apple's Request for Injunction against Samsung's Products Denied

Lucy Koh, the California District Judge, has recently denied the request of Apple for preliminary injunction against a few products from Samsung, which Apple claimed, infringed its patents. Consequently, Infuse 4G, Galaxy Tab 10.1, Galaxy S 4G, and Droid Charge will be available to consumers in the US, even as both companies continue the legal battle over patent infringement.

Judge Koh has said that the court arrived at this decision as Apple failed to convince the court that the company will suffer irreparable harm if the products of Samsung are not removed from the market. Both the companies will have to present detailed and complete arguments when the case will appear in the court next year.

Samsung, in a statement, has said that this ruling of the court has confirmed that the arguments of Apple lack merit. A spokesman from Samsung has said that the substantial questions which the company has raised about the validity of some of Apple's design patents were recognized in the court. He has also said that the company is confident that when the case goes for trial on July 30, 2012, it will be successful in demonstrating the distinctiveness of its devices. Apple, however, has declined to comment on the ruling.

Apple can focus on solid technical patents and not on design patents. It is possible that as long as Samsung makes products which consumers consider attractive, and are sufficiently distinct in order to comply with the laws, Apple will do well in the market.
